By accessing or using Mingo ("Mingo," "we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app.
1. What Mingo Is (and Is Not)
Mingo is a platform that allows users to connect with others for potential roommate or housing-related arrangements.
Mingo does NOT:
- Conduct background checks
- Verify user identities or information
- Assign roommates
- Guarantee compatibility, safety, or outcomes
- Participate in or manage leases, payments, or housing agreements
Users are solely responsible for evaluating, communicating with, and deciding whether to live with other users.
Users are solely responsible for conducting any due diligence they deem appropriate before agreeing to share a living space with another user, including but not limited to verifying identity, conducting background checks, and meeting in person.
2. Eligibility
Mingo is available worldwide. By using Mingo, you represent that:
- You are legally permitted to use the app in your country
- You are at least 17 years of age
- You are capable of entering into a binding agreement
- You will comply with these Terms and all applicable laws
3. User Accounts & Content
You are responsible for:
- The accuracy of the information you provide
- All activity under your account
- Safeguarding your login credentials
You retain ownership of content you post, but you grant Mingo a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content solely for operating the platform.
We may remove content or suspend accounts at our discretion.
Your use of Mingo is also subject to our Privacy Policy. Mingo does not access, collect, or store any data from university systems or student records. All data is provided voluntarily by users.
4. User Conduct
You agree not to:
- Harass, threaten, or abuse others
- Engage in discrimination or hate speech
- Impersonate others
- Engage in illegal activity
- Use Mingo for commercial solicitation without permission
We reserve the right to investigate and take action, including suspension or termination.
5. Safety, Risk, and Assumption of Risk
Interactions with other users occur at your own risk. Mingo does not control what happens off the platform and is not responsible for:
- Harassment
- Assault
- Theft
- Property damage
- Personal injury
- Emotional distress
- Disputes between users
You are solely responsible for your interactions, both online and offline.
6. Housing & Discrimination Disclaimer
Mingo is not a housing provider, broker, or agent. Users independently set preferences and make decisions.
Mingo does not:
- Make housing decisions
- Require or enforce preferences
- Guarantee compliance with housing laws
Users are responsible for complying with all applicable housing and anti-discrimination laws.
7. Third-Party Referrals & Institutional Sharing
Universities, colleges, housing offices, residential life departments, or other educational institutions or organizations that share, reference, recommend, or link to Mingo do so as an informational courtesy only. Such sharing does not constitute an endorsement, partnership, sponsorship, or assumption of responsibility by that organization.
These organizations bear no liability for user experiences, matches, interactions, or outcomes on the platform. Users acknowledge that any institution's decision to share Mingo as a resource does not create any obligation, warranty, or guarantee on the part of that institution.
Mingo operates independently of any university or educational institution. No institutional referral creates an agency, joint venture, or partnership relationship between Mingo and the referring organization.
8. Payments & Subscriptions
Some features may require payment. By purchasing:
- You authorize applicable charges
- Prices and features may change
- Refunds are governed by applicable platform policies (e.g., Apple, Google)
Failure to cancel subscriptions is the user's responsibility.
9. Termination
We may suspend or terminate your access at any time, with or without notice, for any reason, including violations of these Terms.
You may stop using Mingo at any time.
10. Disclaimer of Warranties
Mingo is provided "as is" and "as available." We make no warranties regarding:
- Accuracy of user content
- Compatibility
- Safety
- Uninterrupted service
- Error-free operation
11. Limitation of Liability
To the maximum extent permitted by law, Mingo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Personal injury
- Emotional distress
- Lost profits
- Data loss
- Housing disputes
Our total liability shall not exceed the amount paid by you to Mingo in the last 12 months (or $100 if none).
12. Indemnification
You agree to indemnify and hold harmless Mingo from any claims, damages, or expenses arising from:
- Your use of the app
- Your interactions with other users
- Your violation of these Terms or applicable law
13. Arbitration & Class Action Waiver
IMPORTANT: You agree that disputes will be resolved by binding arbitration, not in court.
You waive the right to:
- Jury trials
- Class actions
- Representative actions
Arbitration will be conducted on an individual basis. (Some jurisdictions may limit this section.)
14. Intellectual Property
Mingo and all related content, features, branding, design elements, and characters are owned by Mingo or its licensors.
You may not:
- Copy, modify, or distribute the app
- Reverse-engineer or attempt to extract source code
- Scrape, resell, or commercially exploit the platform
Except as expressly permitted, no rights are granted to you.
15. Third-Party Content & Services
Mingo may contain content, links, or services provided by third parties. Mingo does not control or endorse third-party content and is not responsible for its accuracy, safety, or legality.
You interact with third-party services at your own risk.
16. No Professional Advice
Mingo does not provide legal, housing, financial, safety, or professional advice. Any information provided through the app is for general informational purposes only and should not be relied upon as advice.
17. Export & Legal Compliance
You may not use Mingo in violation of U.S. export laws, sanctions, or applicable regulations. You represent that you are not located in a country subject to U.S. embargoes and are not on any restricted or prohibited party list.
18. App Store & Platform Rules
Your use of Mingo is also subject to applicable app store terms (such as Apple App Store or Google Play policies). In the event of a conflict, required app store rules will govern.
Mingo is not responsible for actions taken by third-party platforms.
19. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles, unless local law requires otherwise.
20. Changes to These Terms
We may update these Terms at any time. Continued use of Mingo means you accept the updated Terms.
